Recent Case Successes
for Herman Howry & Breen LLP

In late 2005 and early 2006 Tim Herman and Sean Breen were very busy handling all litigation matters for Lance Armstrong and his cycling team.
Professional Negligence - In a case that included a successful ruling in the Supreme Court of Texas, Sean Breen prosecuted and won a large settlement in a matter involving professional negligence against multiple defendants.
The Louisiana Supreme Court affirmed a judgment secured in favor of the Williams Companies of Tulsa , Oklahoma under which IMC Global and Freeport McMoran recovered nothing in a $12.3 million suit tried by Tim Herman for Williams in Baton Rouge , Louisiana state court.
An Administrative Law Judge, after a bench trial, issued an order overturning an attempted “termination for default” by Dallas Area Rapid Transit (DART) and the Ft. Worth Metropolitan Transit Authority (The T) against Agent Systems, Inc., represented by Tim Herman and John Hempfling.  The contract was for $9.7 million and involved the design and installation of a new fare collection system for the two transit authorities.  A further trial will be held to determine the amount of damages to be recovered by Agent Systems.
Sean Breen successfully defended a corporation and current and former employees and officers against a seven figure claim for alleged breach of contract, fraud, corporate raiding, usurpation of corporate business activities, misappropriation of confidential information, breach of fiduciary duties and tortuous interference.

Scott DeShazo Named Partner

Scott DeShazo was named a partner at Herman Howry & Breen, L.L.P. in early 2006. Mr. DeShazo’s litigation practice focuses on employment law, commercial and business disputes, constitutional law, professional liability and personal injury with experience in insurance litigation. He is licensed to practice in both state and federal courts.

Mr. DeShazo holds a Bachelor of Arts from Baylor University, a Master of Theological Studies from Vanderbilt University and a Doctor of Jurisprudence from Texas Tech University.

Firm Provides Training to
CASA Volunteers

In March 2006, Tim Herman conducted a training session for the executive directors of local chapters throughout the state of CASA (Court Appointed Special Advocates). CASA serves thousands of foster children across Texas as their special advocates, especially in issues related to the legal courts.

Computers Donated to
American YouthWorks



Herman Howry & Breen LLP recently donated computers for the Austin Bar Association’s American YouthWorks Computer Drive. The computers have been reprogrammed and placed in the homes of needy students for use in school work, job and higher education research.
